In California, the average cost of assisted living care in California tops $8,000 every month. Most private insurances don’t include assisted living expenses in their coverage, even if the policy holder doesn’t know that. Medicare also does not cover assisted living costs. Medi-Cal, the state’s Medicaid program, can cover a portion of these costs; however, there are strict resource and income requirements, a variety of other criteria you need to meet in order to qualify, and a complex application process. Many elderly adults in need of assisted living care find themselves stuck in a catch-22 of not having enough money to pay for care but having too much money to qualify for Medi-Cal. There are many legal ways out of this situation, though. If you plan ahead and protect your assets, you can still use them without becoming ineligible for aid! Our Sacramento assisted living planning attorneys can help you understand your options and safeguard an inheritance for your loved ones. We will take care of all of the paperwork for you, including your Medi-Cal application, so you don’t have to stress!

Rely On Our Sacramento Assisted Living Planning Attorneys To Provide Maximum Legal Protection For Your Legacy.

If you don’t plan for assisted living costs, one of three things may happen. You could need to use the savings you’ve built up – the ones you intended to leave to your family when you pass away – and even sell some of your possessions in order to pay for care. You could become a financial burden on your family, who may have to subsidize your care or go into debt to be able to afford it. Or you may have to forgo the care you need if neither of those is an option and you do not have a way to pay for care.

There are many options for assisted living planning. Depending on your specific life circumstances and goals, one or more of the following may be used:

Asset exempting – There are certain assets that are exempt from being counted when it comes to qualifying for Medi-Cal. You can legally shelter your assets by converting them from a non-exempt classification to an exempt classification.
Gifting – Some seniors attempt to circumvent the eligibility requirements by giving all of their assets to their family members, but Medi-Cal has a 30 month “look back” period; essentially, it considers any assets that you gave away within 30 months of applying to count as your resources. You can make gifts earlier than 30 months, with careful planning.
Creating a trust – An irrevocable trust is a legal tool that owns assets outside of your name. You are still able to manage the assets in the trusts by setting certain terms, but they do not count towards your Medi-Cal eligibility. Properly drafted trusts can escape Medi-Cal recovery claims and minimize taxes!
