Many people dream of gaining citizenship in the United States, where there is an ample amount of opportunity for both work and leisure that many other places cannot offer its residents. Citizens of the United States have access to a variety of freedoms and rights that can be a huge improvement from other countries.

Unfortunately, the American dream isn’t necessarily easy to achieve. In fact, there are a myriad of legal hurdles put in place that make it difficult to accomplish gaining citizenship.

That’s why it’s important to enlist the assistance of an experienced citizenship lawyer who can help you skillfully navigate the intricacies of immigration law, and understand and meet the requirements for gaining citizenship. Call Equal Justice Law Group to schedule a Consultation and discover your next steps.

Requirements For Citizenship

We can assist you with meeting all of the requirements for citizenship (naturalization) which include the following:

  • Be 18 years or older
  • Permanent Residency (Green Card): You must be a lawful permanent resident (green card holder) for a certain period of time, typically five years (or three years if married to a U.S. citizen).
  • Physical Presence: You must have been physically present in the United States for a specified amount of time, with the majority of the time spent within the U.S.
  • Continuous Residence: Maintain continuous residence in the U.S., meaning you have not stayed outside the country for extended periods.
  • Good Moral Character: Demonstrate good moral character, which includes factors such as criminal history, taxes, and other considerations.
  • Basic English Language Proficiency: Ability to read, write, and speak basic English. There are exemptions for certain age and residency combinations.
  • Knowledge of U.S. Government and History: Pass a civics test to demonstrate knowledge of U.S. government and history. The test is administered during the naturalization interview.
  • Oath of Allegiance: Take the Oath of Allegiance to the United States during a naturalization ceremony.
  • Filing Form N-400: Application for Naturalization, with the U.S. Citizenship and Immigration Services (USCIS).
  • Interview and Biometrics: Attend a naturalization interview where you will be asked questions about your application and background. Provide biometrics (fingerprints).
  • Receive Decision: Receive a decision on your naturalization application. If approved, you will be scheduled for a naturalization ceremony.
  • Attend Naturalization Ceremony: Take the Oath of Allegiance at a naturalization ceremony, officially becoming a U.S. citizen.

About Form N-400

This is a lengthy, 20 page application for naturalization. It requires you to provide personal information, employment history, travel history, and familial history. There are many aspects of this application that may be challenging to understand, which is why it’s crucial to enlist the assistance of a citizenship attorney who can simplify instructions and ensure that you avoid making mistakes that could compromise your application status, making you ineligible to become a citizen. It’s also important that you are completely honest on your application. Lying on your application is cause for denial, as well as failing the English and/or Civics test, having a criminal history, or failing to meet continuous residence and physical presence requirements
