What Are E-1 & E-2 Visas? 

The E-1 and E-2 visas are both nonimmigrant visas that allow individuals to enter the United States for specific business-related purposes. These visas are part of the U.S. treaty trader and treaty investor visa categories. You can typically remain in the United States for up to two years on an E-1 or E-2 visa. Requests for an extension can be made in increments of 2 years, and there is no limit on the number of extensions that can be granted, but permanent residence cannot be obtained through an E visa. Spouses of E-1 or E-2 holders can apply for an E-1 or E-2 dependent visa that allows them to reside in the United States as well. 

E-1 Visa (Treaty Trader Visa): 

The Purpose: The E-1 visa is for individuals from countries that have a treaty of commerce and navigation with the United States. 

Eligibility Requirements: 

  • The applicant must be a national of a treaty country. 
  • The trading company must have substantial trade between the treaty country and the United States. 
  • The applicant must be coming to the U.S. solely to engage in substantial trade. 

Key Points: 

  • “Substantial trade” involves the continuous exchange of goods, services, and technology. 
  • The visa is often used by individuals involved in international trade. 

Required Forms & Documents: 

  • Nonimmigrant Visa Electronic Application, Form DS-160.
  • Nonimmigrant Treaty Trader/Treaty Investor Application, Form DS-156E, completed and signed.
  • A passport valid for travel to the U.S. The validity date must be at least 6 months beyond the applicant’s intended period of stay in the U.S.

E-2 Visa (Treaty Investor Visa): 

The Purpose: The E-2 visa is for individuals from countries that have a treaty of commerce and navigation or a bilateral investment treaty with the United States. 

Eligibility: 

  • The applicant must be a national of a treaty country. 
  • The investor or the investing company must make a substantial investment in a U.S. enterprise. 
  • The applicant must be coming to the U.S. to develop and direct the investment enterprise. 

Key Points: 

  • “Substantial investment” is typically considered an investment that is significant and at risk. 
  • The visa is commonly used by entrepreneurs and business owners. 

Required Forms & Documents: 

  • Nonimmigrant Visa Electronic Application, Form DS-160.
  • Nonimmigrant Treaty Trader/Treaty Investor Application, Form DS-156E
  • A passport valid for travel to the U.S. The validity date must be at least 6 months beyond the applicant’s intended period of stay in the U.S.
  • One (1) 2×2 photography
